Mr Martin McMahon appealed a decision by the Press Ombudsman not to uphold a complaint that a podcast published by the Irish Independent breached Principle 1 and 3 of the Press Council’s Code of Practice.

Mr McMahon submitted his appeal on the grounds that there was an error in the Press Ombudsman’s application of Principle1 of the Code of Practice.

At its meeting on 25 March 2026, the Press Council considered the appeal on the grounds relied upon and on the information, documentation and submissions provided to the appeal.

Appeal decision

The Press Council of Ireland decided to not uphold Mr McMahon’s appeal, which claimed that the Press Ombudsman had erred in her application of Principle 1 of the Press Council’s Code of Practice. The Press Council found that the Ombudsman had correctly applied Principle 1 of the Code.
